In addition to Chapter 7 and Chapter 13 bankruptcy, the government has enacted legislation to protect consumers against unfair lending practices and creditor harassment. Consumer protection laws include:

  • Fair Debt Collection Practices Act (FDCPA): This law regulates what debt collectors are allowed to do when trying to collect on a debt. It prohibits harassing phone calls, mail and threats.
  • Truth in Lending Act (TILA): This statute requires significant disclosures by creditors to the borrower before the latter agrees to any sort of credit arrangement.
  • Home Ownership and Equity Protection Act (HOEPA): This is an amendment of TILA that imposes very strict reporting requirements on certain mortgage lenders (primarily second mortgages and refinances) and extra disclosures that borrowers have to sign for adjustable rate mortgages (ARMs), etc.
