What Is Chapter 13 Bankruptcy?

Chapter 13 bankruptcy is available to people who have secured debt (a debt tied to an item of property such as a car or a home) and for many people who do not qualify for Chapter 7 bankruptcy. The goal is to have the debt cured or repaid in a three to five year Chapter 13 payment plan. The payment plan does not necessarily repay the full value of your debts, but creates a payment schedule that you can afford. At the end, the debts you have not paid off on most types can be discharged.

Under a Chapter 13 bankruptcy payment plan, you still need to make current house payments. When you file, you are required to take charge of your obligations and stick to the agreed upon plan. You will make your regular payments on your home as well as your Chapter 13 payments to the trustee to catch up. To qualify for Chapter 13, you must have a regular source of income, whether it's a job, Social Security, child support, a pension or other retirement income, help from a spouse's income or self-employment.

Chapter 13 is for people who had a break in their income and cannot catch up without bankruptcy protection.
